A foreign nurse is eligible to lawfully enter the United States under the TN Visa (for Canadians and Mexicans) or H1B1 and I140 for others under the following conditions:
- Minimum of 3 years active clinical experience (recent).
- CGFNS Certificate or NCLEX and TOEFL.
- RN Diploma or Associate Degree -- only for I140.
- Bachelor of Science Degree or Diploma and 12 years experience -- either H1B1 or I140 or both.
Note: The petitioner (healthcare facility) chooses what visa to file and is guided by the immigration lawyer in the process.
